Legal Question in Family Law in Utah

Mediation gone very bad

Lawyer led me to believe the mediator of her choice was on the Utah State roster. Went to mediation and it failed. After researching I found that Utah court will not hear a case until it has been mediated by a mediator on the roster. Can I request spouse to once again mediate only this time with a mediator that is on the roster? I found out afterward we cannot move forward even with a court date until we have attempted mediation with a certified mediator who is on the roster. Can spouse be forced to commit to a second mediation since we did not resolve anything with the uncertified mediator?

Re: Mediation gone very bad

Generally if the parties stipulate to a mediator, the court will allow that mediator if the mediator has the basic qualifications. If you believe the mediator was incompetent, then you can request another mediation session from the court.
