Legal Question in Family Law in Utah

My mother has custody of my 5 year old daughter. We get to see her occasionally, but my mom refuses to let us visit sometimes for months at a time. Is there a way I can get legalized visitation? We just want to see our daughter. We love her and miss her everyday. We're tired of someone jerking her out from under all the time.

It depends on under what circumstances your mother has custody. Is there a court order of some kind awarding her custody? Why aren't there any visitation orders?, etc. Provided there aren't some other restrictions you haven't mentioned, you have the right to file a petition with the court seeking visitation. Without knowing a lot more about your situation, I'm unclear as to why you wouldn't want to file a petition seeking custody of your own child.
