You may seek child support for the children at the same time you seek for custody. She should pay child support regardless of her custodial rights. If the children have been living in Utah for more than the last 6 months, the Utah court would have jurisdiction. If the children have been with you for more than three months, you can file with a Texas court and ask them to take jurisdiction under the Uniform Child Jurisdiction Act.
