Legal Question in Family Law in Utah

Motion Notices

Can I notice (motions, etc.) my stranged wife via home address and at her place of employments fax machine. She lives in Indianapolis and when I send it to her home she refuses to sign. When I send it to her office via fax, I know that she sees them. Also, is this considered harassment .

Re: Motion Notices

In a motion in California Code of Civil Procedure section 1013 allows service by first class mail. You must add 20 days to the time for service, if the service it outside of the State of California. Good Luck, Pat McCrary

Re: Motion Notices

You only need to mail the notice to her home. The only 'notices' that must be officially served are petitions and orders to show cause - which should be served by a sheriff or other appointed process server.
