If parents were never married, the child lives with mother, and no court orders granting custody rights are in place, can a father take their child out of state against the mother's wishes?

If the father is named on the birth certificate he has equal rights to the mother, and can take the child out of state. Court ordered custody rights are a necessity to determine what change in natural rights should occur.
