Legal Question in Family Law in Utah
Process of Discoveries
I'm the respondent in a Divorce case and answered the petition with a counter petition. Plaintiff answered my counterclaim.
1. Do I need to respond to their counterclaim? 2. Who initiates the discovery process, me?

Re: Process of Discoveries
You do not need to respond to an answer. A petition, counterclaim, and answer to the counterclaim is all that is required. Discovery is usually initiated by a case management order, either party can commence. In a divorce case, usually both parties have a good idea of the issues and assets. The next practical step is to divide debts and property; and decide what happens to the children if any.
