Legal Question in Family Law in Utah

pros - cons for being the first filing for devorce

Are there financial benefits and maybe

stratigic benefits given to the party

that files first? Also what if both

parties know it's over love dead but

maybe one ?$@''&$ party say that

they won't due to relegious beliefs?

How long to arrange maintanence and

or stand before a judge to explain why

the second party is a loveless black

hole with a subarctic temperature?

Mr. Wall I don't know who I can trust

she works with almost everyone and

knows everybody else. Maybe you....

Re: pros - cons for being the first filing for devorce

Psychologically speaking, there may be some advantage to filing first. However, if it's clear that one of you will be filing for divorce soon, either one has the right to bring the matter before the court seeking temporary orders. The court will not consider the reasons for the breakdown of the marriage. As far as whether she knows me, unless I know her name, I can't answer that question. You are certainly welcome to contact me via email so we can set up an appointment for a free consultation.

There may be some advantage to filing first, because the filer will be able to get in front of the court a little bit quicker to get temporary orders regarding support and property issues. The court does not want any explanation of your relationship. If you decide it is over, you can file for divorce. The court is generally concerned only with child issues; alimony and property issues.
