a question refering to parental rights
my question refers to my step son, if the bio-father signs over his rights to him can i get gaurdianship over him, he wants to sign over rights if i can get my step son away from his mother, he has been in trouble alot, he also feels that i am better for my step son, i can give him so much more and get him off of state aid, right now me and my wife are separated, she wants to give me visitation rights, also she wants to give me custody if something happens to her, there are alot of people who thinks she isn't taken good enough care of him, the place she lives in is known for drugs, she hangs around all the known users, she has sex in front of my step son, she keeps him out all hours of the night, when they left he was walking, now he isn't she feeds him whole milk with no other food, but he looks good he is gaining wait, the place they live is always a mess, he has now room to walk or crawl around, i am affraid he isnt getting what he needs, we went to the ER for an earache and she never went to his follow up appointment, she quit giving him his perscription after 3 days, when he was suppose to take it till it was gone, anyways me and the bio father want to know if he sign over rights what would that do for me on getting custody?

If bio-dad and mother agree, you can be named guardian through the court. If child is not getting good care, and is in risk call Child Protective services.
