Legal Question in Family Law in Utah
In a recent custody agreement, my ex husband was ordered to maintain health coverage for our two minor children. I am required to pay one half of all premium, and out of pocket expenses etc. However, I am low-income and my children qualify for Medicaid in the state of Utah. Are there any options that don't require my spending over $300 monthly on medical expenses if my children receive Medicaid?

There are a few issues which should probably be addressed. If your children's father does, in fact, have medical insurance available to him through his employment, then they may not qualify for Medicaid as their primary insurance. However, Medicaid can be a secondary coverage for the children which should pay all co-payments and deductibles not covered by your ex-husband's medical insurance, which would mean you would have no out of pocket costs to you. However, unless you can get a court order to the contrary, you will still need to pay one-half of the children's portion of any out of pocket medical insurance premium paid by your ex-husband.
