Do I have to repay her welfare(state assistance)(ex-wife)

My child support was delinquent but now up to date. ORS is still taking $400 a month out of my checks. 185 for child support and 215 a month for state assistance my ex used. I also pay an additional 175 a month for daycare. This is almost half my monthly net income. Soon I'll need state assistance. Is it legal for them to make me pay for her needing the states help when it was her decision to do this alone? Cant this amount I pay be adjusted due to my low income? Thank you.

If her state assistance was obtained prior to the divorce, and the decree did not address the assistance, you may be required to repay it to the State, however, you may be able to recover it back from her. It will depend on your decree and possibly a future court decision.

You may be able to adjust the amount the state takes, depending on your income. You may want to talk to Utah Legal Services in your area.
