Legal Question in Family Law in Utah
rights of adoption
A woman was given a baby to keep when it was born by the baby's grandmother after 14 months the grandmother came back as legal guardian and took the child back. The question is does this woman have any rights based on a verbal contract between her and the grandmother that she would have custody of the child for it's life?

Re: rights of adoption
It would be very hard to make an oral agreement binding, since a change in custody requires approval of the court. The court should, and generally do, make the decision which is shown to be in the best interests of the child. Any interested party can challenge the decision of a court if all factors are not considered. A guardian ad litem could be appointed for the child, together with home studies and psychiatric evaluations - all of which may change the mind of a court.
