Legal Question in Family Law in Utah

Seperated with no child support.

My wife and I seperated a year and a half ago. She left me with 100% of the marriage bills. The children wanted to live with me. After an incident with the children, I was forced to get a protective order for the children against the mother. The mother hasn't seen the children in a year (her choice). I tried to get free legal services through legal aid, but was told that I didn't qualify. Somehow, my wife qualified for free services. I paid for an attorney to file for divorce, but couldn't afford to the additional retainer since she contested the divorce. During the protective order hearing, her attorney agreed to have her pay child support. I have yet to recieve any money, and her attorney will not talk to me since they represent her. I can't affort any legal services with the marriage bills and children. Is there a form the I can fill out and submit to get child support until divorce proceedings can be done? I really need help. Thank you.

Re: Seperated with no child support.

You need to file an Order to Show Cause (1) why she should not be ordered to pay child support including back child support under a wage withholding plan; and (2) why she should not be ordered to pay her fair share of the bills. There is not a form for this, but if you go to the courthouse you can request a copy of a similar document from another domestic case. Follow the format, file the original with the court and send a copy to her attorney. When you get the order (which you may have to draft) send a copy to her employer and they will start withholding from her paychecks.

You may call for a free consultation if you wish.
