Legal Question in Family Law in Utah

seperation

If I wanted seperated from my spouse. But want to keep custody of my kids. How can I get the spouse to leave? I heard that in Utah if I leave with out kids than the spouse in the house, along with kids would put me at a disadvantage during divorse time, especially if the that spouse has some mental issues. Is this true?

Re: seperation

You can file for an order of separation or for a divorce and at the same time ask for possession of the house and custody of the children. The spouse would be required to leave. You should NEVER leave your children with a person who is mentally unstable, that may constitute an act of neglect on your part and could hurt your case.
