Legal Question in Family Law in Utah

Sole custody from dead beat dad?

Can I get sole custody over my 8 month old daughter if the dad is a dead beat? His apartment is not big enough for two people and is not made to house two people(300 sq. feet), there's not room for a crib. He doesn't have money to care for himself(feed himself, do his laundry, etc.), and does not have a phone or money for a pay phone. He has only bought her four items of clothes, one teething toy and has only bought her diapers, wipes and food once since she was born. He has no means of transportation, so in order to see her my parents have to drop her off. He has a hard time keeping a job and the last two jobs he has had since she was born have only been part time and minimum wage.

Probably. File for custody in court.
