How does my son get back child support for a child that is not biologically his?

My son just found out from his DNA test that he is not the biologically father of a child that he thought was his. The child is 9 years old. His wages have been garnished for the payments for the child. Will he be able to get this money back from the state that has garnished his waged for this?

Probably not. It was your son's obligation to ascertain whether he was the father 9 years ago. Now that he knows the question is what is in the best interests of the little boy? If your son is active in his life, he is the only father the 9 year old knows. It would be very wise and responsible for him to keep up the relationship with the child - the child does not need to learn that he is disposable.
