spouse removal

my wife says she is unhappy and wants me to leave. can she have me forcefully taken out of my own home? There is no history of domestic violence.

The only way she can have you forcibly removed from the home is if she is able to obtain a Protective Order from the court based upon a claim of domestic abuse or violence. Although there may be no history of that occurring, you should be aware that many times women, in particular, are very convincing to a court when they go in and make a claim that something has happened. For this reason, I would be extremely careful what you say and do around her. If she's wanting you to leave and if she's intent on pursuing a divorce, you may be better off making arrangements to find another place to live since that may be what you will end up having to do in any event.

If she files for divorce, she can also file for possession of the house. You can also file for possession of the house. If there are children, possesion of the house will like go to the custodial parent.
