Legal Question in Family Law in Utah

Soon to be Step dad wanting to adopt .

Dad is not listed on birth certificate, livesin Colorado, and has had nothing to do with my son ( who is 10)through my son's life. Did has paternity test done to proove he is father. Question: can my fiance of 7 years adopt my son with out much of bio dad doing anything about it? Fiance has taken care of and been there everyday like a dad since my son was three.My son has never had relationship with bio dad, never been to visit to dad and doesn't have phone call's from his bio dad.

Any help would be great!

Yes. Utah law assumes that the bio dad abandoned any interest in the boy by his lack of involvement. The stepparent adoption would be simple.
