Legal Question in Family Law in Utah

Student loan

During the 13 yr marriage spouse accrued about 15 grand in student loans. Only about 2 grand is left. he wants me to pay half. (this remaing amount has been in limbo for the past 5 years and now due) Can I argue that I've paid half all along. I was raising 4 kids from previous marriage-he dropped out of school anyway. I really didn't benefit. Our deal was he would go to school to get a career and then i could be a stay at home. It didn't work out that way cuz he dropped out. Please advise. He wants to take me to small claims court immediately rather than settle in the divorce proceedings. He hasn't provided me any documentation on the loans. I have no idea where the payment, where the pymt goes, etc.

You do not need to agree to anything like this. Your settlement in divorce is usually a mutual agreement. Ignore his threats of small claims court - tell him to go ahead. The judge will not take judgment against you because of the pending divorce.
