Legal Question in Family Law in Utah

Summer Visitation

I gave my ex notice of my summer possession on March 19th 2007 which was before the April 1st deadline. I had made a typo on the time picking him up and when I called to clear it up with her she wanted to go by the wrong time. I had accidentally said that I would be picking him up at 12 noon and returning him at 6pm at the end of my possession. The order always goes by a 6pm time frame. I had told her that I would go by the noon pick up and have him back by noon at the end of my possession as long as I felt I could trust her that everything would go smoothly & with no problems. Due to certain circumstances I no longer feel comfortable with the agreement & would prefer to go by the times that the order always uses. She has told me that I can no longer make any changes to the notice I gave her & that I cannot pick him up at 6pm. She has also said that if I do not show up at noon to pick up our son that she will take that as me forfeiting my summer possession. I am not wanting to change the dates to which I am picking up our son I just would feel more comfortable going by the times that the order says to go by. Can I legally pick him up at 6pm instead of noon?

Re: Summer Visitation

Without seeing the existing orders your question cannot be answered. You will need to take the documents to an attorney to get an opinion. BTW, your real problem is that you and your ex obviously cannot communicate. You should consider enrolling in the high conflict resolution classes to create a parenting plan, sponsored by the Third District Court in SLC. It would help.
