Legal Question in Family Law in Utah
Typical supervision requirement for sex offender?
My ex husband plead guilty to two counts for forcible sexual abuse (2nd degree felony) in 2002. The divorce states that there will be supervised visitations with our daughter (now 7 - victims aged 14 and 15) as mutually agreed upon. He is now wanting to have the supervision removed and/or add his new girlfriend as the supervisor. I feel that she would not have my daughter's best interest at heart and thus would be a poor supervisor. He is claiming that supervision is not typical after such a long time period. Previously his argument has been that she isn't in his victim age range, but I fear that if this is removed, when she is in his 'age range' I won't be able to put it back on. I want to do what's best for my daughter. Please help!

If your ex-husband wants to modify the decree, he has the burden of proving to the court's satisfaction that he no longer poses a threat. Until he does that, the court order stands and he has to abide by it.

Stick to the current orders. Your ex is a pedophile, and you know nothing of the girlfriend. You are the only one who will protect your daughter. Do not agree. Make him produce expert witnesses (doctors) who will attest to the fact that he does not represent a risk to your daughter.
