Legal Question in Family Law in Utah

Unmarried and pregnant

I am pregnant and currently not married, the biological father and I are talking seriously about marriage but do not think we will be married before the baby is born. Will this create any issues for the baby or other person if something happens to either one of us before we are married? I heard that unmarried parents are not considered legal guardians in the State of UT unless they have gone to court and were granted custody. Is this correct? I want to make sure that waiting will protect everyone if the unexpected happens.

Re: Unmarried and pregnant

An unmarried father is required to go to court within 24 hours of the birth of the child to file for paternity. Until that is adjudicated, he has no rights in the child.
