Legal Question in Family Law in Utah
Utah Alimony payments
I would like to get an approximate amount of alimony before I proceed with divorce. I have been married for 17 years. Dropped out of high school due to pregnacy. My husband works in Alaska and makes $167,000.00 annually. I work from home and make $10,500 annually. I have worked during our marraige but always considered my childrens well being in my work. I worked at a preschool and daycare for 10 years so I could bring my children with me. The pay was under $500.00 a month. We own a home in a upper middle class area with a mortgage of $1,900.00 a month. I have been diagnosed with endometriosis which causes severe pain at times and it would interfere with employment outside of my home.

Re: Utah Alimony payments
The general rule of alimony is that both parties should be able to maintain the same standard of living as before the divorce. While this rarely happens, the intended result is to place the parties on equal footing. In a simple case, if husband earns (gross) $160,000 and wife earns $20,000, the difference is $140,000, which would be divided in two for a net amount due wife of $70,000 a year. This is very simplistic and does not take into account child support or other benefits which may be relevant. The parties often make adjustments for difference in equity in the property settlement (your get house and equity, therefore support is reduced.) You are welcome to call for a free consultation.
