Legal Question in Family Law in Utah

Utah guideline Visitation question

The Utah minimum visitation states the following for ages 5-18:

one weekday evening to be specified by the noncustodial parent or the court from 5:30 p.m. until 8:30 p.m.; or

(ii) at the election of the noncustodial parent, one weekday from the time the child's school is regularly dismissed until 8:30 p.m., unless the court directs the application of Subsection (2)(a)(i);

The way I understand the above is that it is my choice if I want to pick her up after school or at 5:30.

Please advise. Can this fluctuate if one week I can pick her up after school and the next week I can't so it has to be 5:30? Ex is trying to tell me I can't have her until 5:30 period. He says the guideline says 5:30 only.

He agreed to the guidelines but doesn't understand them. And I want to clarify them. My lawyer said it was open for how one wants to interpret it. With my ex' personality I need to be able to clarify it.

Thanks

Re: Utah guideline Visitation question

The noncustodial parent is entitled to weekday visitation from either after school, or 5:30 PM at the choice of the non custodial parent. The end time for weekday visitation is 8:30 pm when the child needs to be returned to the custodial parent.
