Legal Question in Family Law in Utah

Ex wife owes me money, can i take her car?

I filled for bankruptcy with my ex wife while we were married. It was a chapter 13 so we had to make five years worth of payments toward our debt. Two years into the bankruptcy we seperated and the divorce was finalized a year after that. In the divorce decree she recieved the car, and the bankruptcy payments split between the two of us. Knowing that she would never make a payment and that it would ultimately fall on me to do so, I payed off the bankruptcy. I have now recieved the title to her car (it was part of the bankruptcy). As I see it she owes me about $5000 for her part of the bankruptcy payments. Can I hold the title until she pays? Or can I take her as payment? Can I sue?

You can demand payment from you ex for both the debt on the car and the bankruptcy debt. You can keep title until she pays for the car.
