my wife can't support my children and i want to and I am native american and my children are enrolled tribal members do I have special custody rights. Mother is not native american.

You do not get special custody rights. The Indian Child Custody Welfare Act deals only with situations where the state takes custody of a child. You will have to return to the court where the divorce was granted and seek custody there.
