Legal Question in Family Law in Utah

My X is taking a personal vacation. I am accepting first right of refusal. I will incur work related day care expense which wouldn't exist otherwise. If the day care expense exists only because of her personal travel, do I still have to pay 1/2 the expense?

Yes. Because you will have custody and are incurring expenses while you are at work. The test is not what you ex is doing, but whether you need day care while you are at work. The good news is you get additional time with your child(ren.)

Yes, you would be required to pay one-half of all reasonable work related child care expenses and your ex would pay the other half and be obligated to reimburse you that one-half that you will pay.
