Legal Question in Civil Litigation in Utah
Abandoned personal property
After restoring an antique car for a customer, he sold the car at auction, there was an unrestored body included with the sale. It was stipulated the new owner would make arrangments to pick up the body and parts. This has not happened, it is now over 3 years later and I have stored it awaiting pickup. I sent him a registered letter with a bill for storage and related costs, giving him 30 days to pay the bill and pick up the parts. Do I have to place a lien on the parts requiring an auction to sell? Because it is just the body there is no title. Or can I convert them to my own use for the unpaid bills and sell the items privately. I have an offer for more money than is owed, if I sell the parts, do I have to send the defaulting party the money for the overage?
Thank you.

Re: Abandoned personal property
You may keep or sell the parts. Notice was given and the owner failed to respond. After 3 years he has abandoned the property.
