Legal Question in Civil Litigation in Utah

borrowed automobile

My friend borrowed my truck. the hood went up on him. He was on a 35 mph road. I had driven the truck on the freeway 2 days earlier going 75 mph. none of my hood latches are broke. I now need a new hood. Who is at fault.

There are not enough facts to asceratain liability. What was the agreement between you and your friend? What kind of road was he driving on? Had he opened the hood prior to it coming open? Could someone else have opened the hood? How much is your friendship worth?
