Legal Question in Civil Litigation in Utah

herion addict

I have a neice who just turned 21 years old today. She is a herion addict. Her dad passed away and she lives with her moms parents. Who are clearly in denial. She wants to check into re-hab and she has the money, from a law suit due to her fathers death, to pay the bill. She does not have full control of her money, her aunt is on her account as well. I need to keep this short as possible I am wanting to hire a lawyer to try to force the family to lock her up, and let her have her money to pay. I see no other reason to let it sit in the bank while she slowly kills herself. Let me be clear that I believe that she wants help She has kept this from me for 2 years and for some reason she called me yesturday to make me aware of the situation. Is this at all possible

Re: herion addict

It is possible. The terms of the trust that holds the money will govern her access to her money. Generally the money is available any time there is a "need." However, if grandparents are in control they will probably have to be convinced. The best way to do that is an intervention with both your niece and them present. If they still refuse, you can apply to have a court intervene and order the treatments.
