land

my neighbor has 5 foot of my property and says that i can not move her fence where it is suposed to be what can i do the fence has been there for over 20 yrs we have mesured so im paying taxs on land i can not use what can be done

The safest thing is to file suit getting a declarative judgment that the true property line is the correct line. If you remove the fence, the neighbor will sue you for the cost of the fence. Either way you have a suit, but if you should lose on your declarative judgment, you will not be at risk for the cost of the fence. If you win, the neighbor will have to remove the fence.
