Legal Question in Civil Litigation in Utah

Legal rights of horse owners & boarding facilities

If I am unable to pay the past & present board fees, can my horses & horse trailer be taken from me. I have been looking for work for 6 months, but I am 60 years old & have not been successful. The boarding facility owner has threatened me with selling the horses to a slaughter house, refusing to let me remove my trailer form the property, taking me to small claims court and anything else that can be spewed out as they have been extremely unpleasant. I want to pay, but I am struggling financially & I have no resources to fall back on as there were some major reversals in my income 6 months ago. I need to know if I have any legal recourse in this matter. Thank-you.

Re: Legal rights of horse owners & boarding facilities

Read the agreement you signed with the facility. In general a provider of services can assert a lien against the owner's property for unpaid services, which includes the right to sell the property after proper notice to pay the costs of service rendered. You need to make some arrangements to pay for the services or the facility can exercise its rights.
