Legal Question in Civil Litigation in Utah
liability for damaged property
my son is 16, just received driving license. His sisters friend asked him to take her car and drive a sibling to practice. he stated no, cant drive a stick shift. He went over instructions with him and told him he would be fine and to go. Gone 5 minutes, said stalled auto once on trip. they state now transmission bad and want me to pay. I do not feel he is responsible, do not know what condition auto was in prior, feel he was set up. need to know liability because he did get in the car and drive it.

Re: liability for damaged property
Unless your son was demonstrably negligent, his friend assumed the risk. Do not pay unless it is clear your son was very negligent.
