Legal Question in Civil Litigation in Utah

liability for son's auto accident with injury

Need to know our liability in our son's auto accident that resulted in injury to niece that was a passenger in vehicle. Her father is trying to get us to admit our son was completely at fault and admit we are liable for care costs. He wants to have us show all of our assets and liabilities so he can decide how much we need to pay him.

Re: liability for son's auto accident with injury

You did not provide enough details for a complete answer. If your son was insured on your car, the insurance company is liable for the niece's injuries up to the policy limits. If your son was uninsured on your car, you are liable for the niece's injuries, your insurance will probably decline the claim under policy provisions which limit their liability to insured drivers. If the car was your son's, he or his insurance is liable. In any event, you do not need to show your assets to the niece's family. The amount she is owed is the cost of her health care for her injuries, plus something for her pain and suffering.
