Time Length?

My husband and I had a lawsuit brought agains't us over eight years ago. The Plaintiff is not actively pursuing the suit, it seems to have been forgotten. How many years should we wait before we petion the court for dismissal? The Judge assigned to the case has retired.

Re: Time Length?

The case has probably already been dismissed. Contact the court to check on the status. If still active you can petition for dismissal under failure to prosecute if nothing has been done for at least a year.
