Legal Question in Civil Litigation in Utah

Vehicle damaged at salvage yard

Our car was rear-ended then towed to a salvage yard for damage appraisal. The insurance company totaled the vehicle. (Still a very nice and drivable car.) We recieved payment for the vehicle minus the salvage value because we recoved the vehicle. We went to pick up the vehicle and noticed it had additional damage. The drivers side doors were dented. We complained to the yard manager and were told to get an estimate and they would pay for it. On our way to get the estimate we noticed that the floor boards were pushed in. We had two different companies give us estimates for each item individually. It is apparent that the damage to the floor was caused by a forklift at the salvage yard. When we returned to the salvage yard we told them about the additional damage to the floor and gave them the estimates. They told us they would pay for the door to be fixed locally but would do nothing for the floor. We stated that we wouldn't be in the local area long enough. They called our insurance company who basically said we weren't entitled to anything and the negotiations ended there.

It doesn't seem right that they can do additional damage without liability. Am I in the right seeking compensation or should I stop at salvage value?

Re: Vehicle damaged at salvage yard

You are entitled to the additional damage caused by the yard. You may have to go court to get your money.
