verbal contract

This woman asked my husband if he would sell her a vehicle we had sitting in our driveway, he said yes and told her he was going to sell it for $2800 but he would sell it to her for $2200 to help her out because she was the girlfriend of one of his friends, she paid him $500 and a week or two later she gave him another $500 then she lost her job and told him she wanted her money back he told her no she made a verbal agreement (we have a witness) now she has been harrassing him and is threatening to take him to small claims court, who is in the right? who would win the case? we feel that because she agreed and made 2 payments that she still owes us $1200?

Re: verbal contract

The terms of an oral agreement can be found to be enforceable and binding in court. You have options, 1) require her to make the payments; 2) have her return the car and forfeit the amounts paid; 3) make another deal; 4) go to court.
