Legal Question in Immigration Law in Utah

false documentation

My ex girlfriend filed some charges against me using one social security number and worked with a different one. I think she may be illegal is there anyway to put an end to this and get my kids before she takes them with her.

Re: false documentation

I understand your concern, but your issue should be taken before a domestic relations court for several reasons. If your wife has a good lawyer, she may not have any problems defending herself against deportation, if that is what you are thinking "could" happen. You say she filed charges against you -- what charges -- and have you been convicted? Second, if you are in the midst of a separation and divorce, you must iron out the issue of the children quickly. All will depend on your character and ability to take care of your children, and hers. Most courts will award the children to the mother, unless she is an ax murderer or something. So, unless you can show that she is not worthy of having the children because she used a false social security number, but that you are worthy despite the fact that you have a charge against you, it is better to try to negotiate these issues before a family court. The best of luck to you.
