Legal Question in Immigration Law in Utah

Reasonable costs to return home

Our company recently laid off an H1B worker. What options are considered reasonable in assisting the worker to return home? Is the company responsible for returning family members as well?

Re: Reasonable costs to return home

Dear Inquirer:

The company is responsible for paying the reasonable costs of return for the employee only, however, the USCIS views enforcement of this provision as a private contractual matter. "Reasonable" means purchasing a standard "coach" airline ticket in a timely manner following his dismissal.

I recommend that you email [email protected] or visit www.hanlonlawgroup.com if you would like to schedule an appointment for a confidential consultation to discuss this matter further.
