Legal Question in Insurance Law in Utah
dependent insurance claims
My 18 year old son is listed as a dependent on my
insurance policy. If he recieves treatment and fails
to pay the provider, am I liable for the debt? I did
not consent to the treatment or agree to be held
liable when he was admitted to the hospital.

Re: dependent insurance claims
He should be liable for the debts. At age 18 even though he is your dependent, he is also an adult. The hospital should have obtained your consent for the medical services for you to be held liable. It may take some explaining to the collection agency for the hospital, but persist.
Your insurance contract is an agreement between you and the insurance company that they will reimburse you or the medical services provider for the services according to the terms of the insurance policy. The policy does not create a contract between you, or your son, and the hospital.
