Legal Question in Insurance Law in Utah
financial liability
Our son bought a car with my wife on the loan. She was suposed to be a co-signer but her name is listed first. Our son has lost his insurance but still drives the car. I'm wondering if he is in a wreck could we be made liable cause she is on the loan with him?
thanks.

Re: financial liability
Yes if he is a minor. Possibly if he is an adult. You also have to worry that the financing agency probably has the right to get the insurance and add the premium to the loan. This is very expensive insurance and does not cover liability, only damage to the car. Furthermore, if there is an accident, she will be named in the lawsuit and will have to defend herself - i.e., hire her own lawyer.
She should take the car and hold it until your son gets insurance; or should buy insurance herself; or repossess and sell the car.
