Legal Question in Insurance Law in Utah

Insurance settlement due but being held

I was involved in an auto accident and had a coverage on my insurance that pays me for time I loose due to injuries that I recieved. Insurance company will not pay because they want varification of days worked and wage information from a company that is refusing to release any information due to the fact that I was an independent contractor.I have sent the insurance company my pay breakdowns and because it was a sales position some of the commissions I got were after I had the accident and was no longer able to preform at my job. The sheets show where motels were deducted from my earnings. They were arranged for and money was taken from commissions to pay the bill. The weeks that I was charged for motel shows the time I worked. I was only with the company one week and then off three weeks and I tried to return but due to the sevierity of my injuries I had to quit. This happened in Sept. 2002 and I have not worked since. Doctors will not let me return to work until the problem is fixed and I am off of narcotic pain medication.

Re: Insurance settlement due but being held

If the claim is large enough I suggest you retain an attorney who can process the claim against the insurance carrier. Read your policy for the procedure to follow.
