Legal Question in Insurance Law in Utah
Motorcycle damage
I took my goldwing to a service dealer for a rear tire change, they had it up on a lift, on the bike center stand without being tied down. it fell off the lift onto the floor causing several thousand dollars worth of damage, more than they claim is blue book value. This motorcycle was in tip top shape not one scratch or a blemish on it. It was also paid for. What is my recourse have it rebuilt(if they will) settle for a check for what they consider high blue book or a bike of equal value?

Re: Motorcycle damage
The dealer has to repair or pay the fair market value of your bike - not an average bike. You will have to get a price which you think is fair, based on some objective estimate - or demand that the bike be restored. You probably cannot force the dealer to repair the bike (and I doubt that a repaired bike would be worth it because it will be a salvage bike title.) Shop around for another bike of similar quality, and use that as a benchmark.
