Legal Question in Insurance Law in Utah
I recently had my car broken into, and the insurance company does not want to cover the subwoofer and amp that was installed in the car. I sighted there wording in the policy contract that it had been permanantly installed. I'm thinking since Tolls were used in the installation and there is not a way to remove them without tools that they should replace them. This is from my policy contract custom parts that are included with comprehensive insurance. Custom parts or equipment are covered with my comprehensive insurance. I am wondering if they should have to pay for the subwoofer, amp.:
2. Custom parts or equipment means equipment, devices, accessories, enhancements,
and changes, other than those that are offered by the manufacturer specifically
for that auto model, or that are i nstalled by the auto dealership as part of
the original sale of a new auto, that:
a. are permanently installed or attached; and
b. alter the appearance or performance of the auto.

If you cannot convince the company to pay, you will have to sue. In court you will need to prove that they were installed.
