Legal Question in Intellectual Property in Utah
Publishing images on the web
I am a wedding photographer and my wife is a decorator and florist for weddings. We have 4 or 5 photos on our website from a wedding showing flowers and centerpieces. A few of the photos do contain people. My wife took the pictures herself. Now the bride and groom are demanding we remove their photos from our site and destoy the files. These photos are not used in any advertising but only show our work in the context of the wedding. Can we publish these photos on our site legally?

Re: Publishing images on the web
Your web IS ADVERTISING, and use of photos of persons who have not signed a Model Waiver or Consent have the absolute right not to want their photos on the web. You should get that document signed by anyone whose photo you want to place on your website.
Re: Publishing images on the web
You may not publish the photos without their permission. You should have all people in a photo sign a release before publishing in any manner.
