Legal Question in Employment Law in Utah

BACKGROUND: IF DWS saw someone walk on water, they would say, "What a fraud! That person can't swim!"

The DWS appeal process is a pretense, putting victims at ease and meant to give the false impression to Federal Regulators that everybody gets fair treatment.

I had believed that if they had the relevant facts they would naturally admit their mistake and correct the error, even apologize, as the plain language of the laws made it Impossible to have an invalid claim with DWS or a valid claim with any other state agency.

When it became clear that is not their style I reviewed posted rulings on DWS cases and did my appeals up through the Appellate Court, knowing full well I would have to eventually elevate it to a Federal Court to get an impartial hearing. So what if I don�t know how to write a brief? Never did one before.

The Appellate Court�s direction by code is apparently to rule in favor of the agency regardless of the facts of the case. This may bring up some questions on constitutionality or some other noteworthy law that challenges legality of rules that intervene in impartial judgment. Look up the rulings to see that, though with inconsistent explanations, this is obviously happening. Ex: �Wouldn�t have been court�s ruling if factors were considered denovo�. My experience was the ignoring of requests for denovo review.

The laws themselves are not the issue, except for the directed ruling clause. It�s their institutionalized misapplication, based on confirmation bias in that once a conclusion is formed, things that support that conclusion are given more weight while discounting or ignoring things that disagree with it. Confirmation bias is applied to any attempt to challenge conclusions. For DWS, laws and facts are like playing cards: they simply shuffle them and fan them out to suit themselves. The ends justify the means, and no good deed shall go unpunished!

MY QUESTION: What is next court to file with and does ANYBODY out there deal with this kind of problem? Can make records available.

Am I even on the right track?

OTHER CONSIDERATIONS (Not as important as a willingness to take on a corrupt morally bankrupt agency abetted by the system}: How much of your practice involves unemployment compensation claims? What's your success rate in challenging denials of unemployment claims?
