Legal Question in Employment Law in Utah

Possible blackballing

I was hired for a position through a temporary agency. I completed the duties and was told that I would be hired full time as soon as the employee I was replacing was put on disability. The next thing I knew I was told to leave and not come back. When I called the agency the rep who was handling my file was very nervous and recommended I go to another agency. For several months I was told just keep waiting it would be sorted out. Then the agency rep suddenly was gone. No one there would recommend me for other positions. I then saw the job advertised and applied. I was told by the HR person that the supervisor probably ''just forgot about me''. I feel that someone at the temp agency or the main funding provider for the job gave them untrue information about me or my professional reputation. Do I have a right to request a cause for not being consideres for the position? If I do should it be done through an attorney or can I request it from the HR office on my own?

Re: Possible blackballing

Request in writing the reasons for which you were denied employment, and whether you are on a recommended list for hire or rehire. Send certified, return receipt and keep a copy of your letter. Send one of these to the temp agency and one to the employer. The responses should help you. If you do not get a response, check back.
