Deny before job closing date

I have applied to a company for several times and have always been denied because of a better candidate even though I am well qualified for all the jobs I applied. Anyhow, this time I applied for a job and got an email saying the following ''We are considering other candidates who represent a very close match to our specific needs for this position. You have not been selected for an interview at this time.'' even BEFORE the closing date. Can an employer do that? Or do they discriminate me?

It's an unfortunate fact of life that perfectly capable job candidates can be and are frequently passed over, sometimes in favor of others who are less qualified. That is legal unless you may be a member of a protected class. So, as for "discrimination," unless you can absolutely prove that you were passed over because you are a member of a protected class you would be well advised to simply move on.

On the bright side you may consider that they did not leave you hanging/waiting until after the closing date and you are free to move on.
