Legal Question in Employment Law in Utah
Employee divulged medical info at work
My co-worker told a customer (who also works for our insurance company) that I had had a recent miscarriage. Co-worker asked me to come speak with the customer, I assumed about work, but the co-worker & customer then proceeded to ask about any hospital stay that I may have had. The customer stated that for a miscarriage the insurance would cover things. I hadn't mentioned any miscarriage, I haven't actually miscarried the baby yet we're still waiting for this to happen, and have not spent any time in the hospital. I explained this to the poor customer and he went on his way. I sent an email complaint to my supervisor and my boss explaining that I didn't appreciate the behavior and invasion of my privacy. As employees we have signed some sort of doc that states we will not divulge personal info to customers, over the phone, etc. My supervisor seems to think the co-worker was just trying to help and it isn't a big deal. It is a big deal to me. I have missed 4 days of work due to the emotional stress and the 2nd day back to work this is what happens. I'm now having nightmares again due to this. What legal rights do I have?

Re: Employee divulged medical info at work
You should file a formal complaint with your superiors against the person making the disclosure. You can also file a lawsuit for damages, against the person and company.
