My employer used a false EIN on my W-2

My employer sent me a W-2 with an incorrect EIN (Employer Identification Number for tax purposes). They also did not include a state tax identification number at all. The IRS sent notification that the EIN was incorrect and did not accept my filing. The employer told me they did not have that information but asked me to wait until they could get it to refile my taxes. They still have not given it to me and I suspect they don't have a legal one yet. Taxes are supposedly being withheld but I suspect they are not being paid and my employer is operating without those legal numbers. To whom should I complain and are they in violation of any laws if my suspisions are correct?
