Legal Question in Employment Law in Utah

employment

my employer had me taking care of 42 patients...I had a patient crash and we had not crash cart...no ambu bag or nothing...the patrient died. one of the other patients family memebers reported the incident to the obudsman...I had already filled out a incident report and had turned it in. well they lost it of course. well the obudsman talked to me and I told her everything. my company was mad at me and they did everything to make my life miserable, spread rumors and etc... Then they fired me for a disagreement with a patient the was a misunderstanding r/t a previous disagreement with another employee. Now they are doing everything they can to keep from working. they have told potential employers lies about me and well I am ticked...one of my friends that work for one ofthe facilaties told me what was told the don about me..I had not applied there yet but my freind mentioned that I was avalible for work so she called my previous employer and they told her things about me that were not true...I know in utah it is illegal to say anything except that they would not hire me back. what can I do for recourse

Utah law is quite protective of employers and it is difficult to bring this kind of claim. Look at Utah code sec 34-42-1. I would first see if y ou can get the former prospective employer to state on teh record waht they were told. Then see if it complies with the statute.

You may also want to consider informing the family of the patient exactly what happened. They are entitled to know.

File a complaint with the Utah Division of Labor, Antidiscrimination Division, for retaliation. You will then also be able to sue them for retaliation. You may call for a free consultation.
